How to claim HRA exemption when living in a rented flat with my parents?

I live in a flat owned by my parents and pay them rent. I pay rent to my parents but my name is not on the rental agreement. Can I still claim HRA exemption? What documents do I need? Also, my employer is asking for a rental receipt but my parents do not want to issue one because it will increase their tax liability.

HRA exemption requires actual payment of rent, which must be backed by a genuine rental agreement and rent receipts. If your parents own the flat, you cannot claim HRA exemption against rent paid to them as it would be considered self-occupied property. You can only claim HRA if you pay rent to a landlord who is not a family member or not the owner of the property you occupy.

Even if you had a valid rental arrangement, Section 10(13A) allows HRA exemption only when the employee pays rent for accommodation occupied by them. Since your parents own the flat, it is treated as self-occupied under Section 23, and no HRA exemption is permissible.
